We're in the courtroom for the first time.
JUDGE HALLIHAN presides on the bench. He’s a twinkly, impish man of 64, full of surprises. Marcus and Nancy stand behind their respective tables.
"Your honor," says Marcus, "as far as I can tell there is no admissable evidence here."
Nancy arches her brow and gives Marcus a taken aback look. "We have more than demonstrated probable cause - between the photo lab testimony, the victim - and it's not like we're talking about a member of the church choir here --"
Marcus interrupts. "How is it you so sure he did what you sayin he did? There is absolutely nothing to hold this young man --"
"Cuz the state brought the case against your client. And the state has presented evidence. That’s how I’m so sure."
"I was taught to believe that discrimination against anyone is discrimination against everyone." Marcus shuffles his papers and steals a glance at them, to make sure he knows what's going on here.
Nancy has a syrupy Southern accent, filled with superiority. "I was taught to believe that you shouldn't break the law. And that if you do, you can bet your ass we're gonna discriminate against you."
The Judge finally interrupts this childishness in his courtroom. "Does counsel have actual arguments for probable cause or are we gonna use this hearing as an excuse to keep bickering?"
Marcus continues. He can't let her win. "The idea the system is flawed and fallible is terrifying --"
"'The system is flawed' is what all losers say when they don't want to face justice for their crimes."
"What about when justice makes mistakes? "
"Justice doesn't make mistakes."
"It’s comforting to think that."
"It's comforting to think you can keep obstructing justice without ever facing consequences."
"Was that a threat? In the judge's courtroom?"
Nancy smirks. "Just a reminder that the more you use 'rights' to keep the guilty from being punished, the more implicated you are in their crimes."
Marcus goes in for the kill. "YOU ARE ONE PITCHER OF MARGARITAS AND A REDNECK WITH A HONDA SCOOTER AWAY FROM HAVING YOUR OWN FACE COVERED WITH TATTOOS --"
